Terms of Service

1. General Provisions

These Terms of Service (hereinafter referred to as the "Agreement") govern the relationship between Reliable Communications s.r.o. (hereinafter referred to as the "Company", "We") and the user of the Avatar Match platform (hereinafter referred to as the "User", "You") when using the Avatar Match service (hereinafter referred to as the "Service", "Platform").

By using the Service, you confirm that you have fully read, understood, and agree to comply with the terms of this Agreement.

2. Definitions

• Avatar Match — a web platform for creating AI avatars, finding compatible people, and conducting virtual dating simulations.
• Avatar — a digital representation of the User's personality, created based on psychometric tests and AI analysis.
• Tokens — the Platform's internal currency used to pay for AI functions and services.
• Matching — the process of matching compatible users based on psychometric data.
• Simulation — virtual interaction between user avatars using AI.
• Account — the User's personal profile in the Service.

3. Subject of the Agreement

3.1. The Company provides the User with access to the Avatar Match Platform functionality, including:

• Creating and managing AI avatars based on psychometric tests
• Finding compatible users through AI matching algorithms
• Conducting virtual dating simulations between avatars
• Exchanging messages and coordinating meetings
• Access to events and team projects
• Managing privacy settings and billing

3.2. The Company provides the Service "as is" and does not guarantee uninterrupted operation of all functions.

3.3. Some Platform features are paid and require purchasing tokens or a subscription.

4. Registration and Account

4.1. To use the Service, the User must register and create an account.

4.2. When registering, the User undertakes to:

• Provide accurate and up-to-date information
• Be at least 18 years old
• Use a secure password and not transfer access to third parties
• Immediately notify the Company of unauthorized access to the account

4.3. The Company reserves the right to refuse registration or block an account without explanation.

4.4. The User is fully responsible for all actions performed under their account.

5. User Rights and Obligations

5.1. The User has the right to:

• Use all available Platform features in accordance with their intended purpose
• Create avatars and take psychometric tests
• Search for compatible users and initiate simulations
• Control privacy settings and profile visibility
• Receive technical support from the Company
• Delete their account at any time

5.2. The User undertakes to:

• Not violate the laws of the Czech Republic and their country of residence
• Not use the Service for illegal or fraudulent purposes
• Not post offensive, discriminatory, or illegal content
• Not use automated means to collect data (bots, scrapers)
• Not attempt to gain unauthorized access to Platform systems
• Not impersonate another person or organization
• Respect the rights and privacy of other users
• Follow safety rules during offline meetings with other users

6. Company Rights and Obligations

6.1. The Company has the right to:

• Change the functionality and interface of the Platform without prior notice
• Conduct maintenance with temporary suspension of the Service
• Moderate content and remove materials violating the Agreement
• Restrict or block access of users violating the Agreement
• Change tariffs and token costs with user notification

6.2. The Company undertakes to:

• Provide access to the declared Service functionality
• Protect personal data in accordance with GDPR
• Ensure confidentiality of psychometric data
• Inform users of significant changes to the Agreement

7. Intellectual Property

7.1. All rights to the Avatar Match Platform, including source code, design, logos, trademarks, and content, belong to the Company.

7.2. The User retains rights to content posted in the Service (text, photos, test results).

7.3. By uploading content, the User grants the Company a non-exclusive license to use this content for Service operation, including AI processing.

7.4. Copying, modification, distribution, or reverse engineering of the Platform software is prohibited.

8. Payment and Refunds

8.1. Some Platform features are paid and require:

• Purchasing tokens (one-time purchases)
• Subscribing (monthly or annual plans)

8.2. Payment is processed through Stripe payment system. Stripe terms apply.

8.3. Prices are stated in US dollars (USD) or euros (EUR) and include VAT where applicable.

8.4. For subscriptions, funds are automatically charged at the beginning of each billing period.

8.5. Refunds are possible in the following cases:

• Technical error during charge (full refund)
• Unused subscription within 14 days of payment (proportional refund)
• Non-working functionality due to Company fault (partial refund)

8.6. No refund if:

• Tokens have already been used
• User violated the Agreement terms
• More than 30 days have passed since purchase

9. Privacy and Data Processing

9.1. Personal data processing is governed by a separate Privacy Policy.

9.2. The Company processes the following data categories:

• Registration data (email, name, password)
• Psychometric data (test results)
• Profile data (photos, interests, bio)
• Interaction data (messages, simulations, matching)
• Technical data (IP address, device, browser)

9.3. The Company complies with GDPR requirements and ensures:

• Data encryption during transmission and storage
• Access to data only by authorized personnel
• User rights to export and delete data
• Notification of data breaches within 72 hours

10. Liability

10.1. The Company is not liable for:

• Quality and results of offline meetings between users
• Accuracy of information provided by other users
• Losses arising from technical failures or Service unavailability
• Actions of third parties (hackers, scammers)

10.2. The Company's maximum liability is limited to the amount paid by the User over the last 12 months.

10.3. The User is fully responsible for:

• Compliance with the terms of this Agreement
• Security of their account
• Content posted in the Service
• Interaction with other users

11. Changes to the Agreement

11.1. The Company reserves the right to change the terms of this Agreement.

11.2. For significant changes, the Company notifies users by email 14 days before the changes take effect.

11.3. Continued use of the Service after the changes take effect means acceptance of the new terms.

12. Dispute Resolution

12.1. All disputes arising from this Agreement will be resolved through negotiations.

12.2. Claims are sent to the Company's email. Response time is 30 days.

12.3. If no agreement is reached, disputes are subject to consideration in the courts of the Czech Republic at the Company's registered address.

12.4. The laws of the Czech Republic apply to this Agreement.
